Common Questions About Employment Visa

What is the minimum salary required for an Employment Visa?

The general threshold is a gross annual remuneration above INR 16.25 lakh (roughly USD 25,000), assessed on the total package including allowances and perquisites — not just cash salary. A reduced threshold (INR 9.10 lakh) applies to faculty at central higher-educational institutions, and categories such as ethnic cooks, non-English language teachers/translators and diplomatic-mission staff are exempt. Thresholds are set by the government and change — we confirm the current figure for your case.

What are the E-1, E-2 and E-3 employment visa categories?

Under the 2026 restructure of India's employment visa system, E-1 covers most employment cases (direct hires and consultants), E-2 covers specific intra-company transfer cases, and E-3 covers NGO, missionary and religious workers. Which category fits determines the documents and sponsor requirements — we assess this as the first step of every engagement.

How long is an Employment Visa valid?

Employment Visas are typically granted for 1 year initially or for the duration of the employment contract, whichever is shorter, subject to a maximum of 5 years. Extensions are possible if the employment continues.

Can my family accompany me on an Employment Visa?

Yes. Your spouse and dependent children can accompany you on an X (Dependent) Visa. Your X Visa dependents are permitted to study in India but not to take up employment.

Does my employer need to register anywhere in India?

Yes. The sponsoring Indian employer must be properly registered, have a valid business license, and must often report the employment of the foreign national to the FRRO/FRO after the employee's arrival in India.

What happens if I change employers while on an Employment Visa?

An Employment Visa is employer-specific. Changing employers generally requires a fresh Employment Visa sponsored by the new employer — usually applied for from your home country — with a narrow intra-group exception that needs prior MHA approval. Working for a different employer than the one on your visa without authorization is a violation of visa conditions.
