What is an Exit Permit in India?
An Exit Permit is permission from the FRRO, applied for through the e-FRRO portal, that clears a foreign national's departure when their stay has become irregular or their departure needs clearance: after an overstay, once a visa or residence permit has expired, after a passport is lost or stolen, or for a baby born in India who holds no visa. It is not a visa to leave. Most foreigners with a valid visa need no clearance at all and simply depart through the immigration check post. People often search for an exit visa, but no Indian visa by that name exists, and asking for an Exit Permit by name saves a conversation at the FRRO. What the FRRO asks for, and whether a penalty applies, depends on your immigration history.
Who needs an Exit Permit?
Broadly, anyone whose departure the FRRO has to clear because their stay is no longer regular. MHA's supporting-documents list groups the cases: people who have overstayed or are otherwise ineligible to stay; people holding a new passport after a loss or theft; people who were arrested and later released or acquitted; and babies born in India to foreign parents, who have no visa to depart on. Student and Research Visa holders have their own version of the list, which adds a no-dues certificate from their institution. If your visa is valid, your passport is the one it is in and nothing on your record is unresolved, you generally do not need one; a registered foreigner leaving for good simply surrenders the registration certificate.
Can I leave India after overstaying my visa?
Overstaying is a serious matter, but in most situations there is a lawful route to depart. You will usually need to regularize your status, which can involve an Exit Permit from the FRRO and, in some cases, a penalty. The exact requirements and any penalty amount are determined by the authorities based on your circumstances — we strongly recommend seeking advice as early as possible and verifying current rules with the FRRO.
How long does an Exit Permit take to process?
Processing time varies widely depending on the reason, the FRRO office handling your case, and how complete your documentation is. Straightforward cases may be resolved relatively quickly, while cases involving a lost passport, a long overstay, or additional verification can take longer. What documents are required for an Exit Permit?
MHA's supporting-documents list for an Exit Permit, for all visa types other than Student and Research, asks for a photograph; your passport and visa, meaning the photo page, validity page, arrival stamp page and the visa, or an emergency travel document from your country's mission if the passport was lost; proof of residence; and a travel ticket. Lost or stolen passport cases add the police report or FIR and an embassy letter giving the old and new passport details. Your registration certificate or residential permit is needed if you hold one, and cases involving an arrest need the prosecuting agency's NOC and the release certificate or court order. Student and Research Visa holders add a no-dues certificate from their institution. The portal may ask for more, commonly a written explanation of an overstay.
How much does an Exit Permit cost in India?
There is no single published price. What you pay depends on whether an overstay penalty applies and how long the overstay ran — the penalty and the Exit Permit are two separate things, and the penalty schedule is set by the government and changes over time. Confirm current figures through the e-FRRO portal or your jurisdictional FRRO rather than relying on numbers found online.
Is an Exit Permit the same thing as an exit visa?
People search for both, but "Exit Permit" is the correct term. There is no Indian visa category called an exit visa — what is issued is a permit clearing your departure, not a visa authorising it. If you have been told you need an exit visa, an Exit Permit is almost certainly what is meant.
Does a baby born in India need an Exit Permit?
Yes, if both parents are foreign nationals, before the baby's first departure. A baby born here has a passport from its parents' country but no Indian visa and no arrival record, and MHA lists an Exit Permit for a newly born child as its own FRRO service, applied for through e-FRRO. The documents on MHA's list are a photograph of the baby, the parents' passports and visas, proof of residence, a birth certificate showing both parents' names, the baby's new passport or an emergency travel document from the parents' mission, and a travel ticket. Families staying on apply for a New Visa for the baby instead. If one parent is an Indian citizen, the baby may be an Indian citizen by birth, so check that first.
Can I leave India without an Exit Permit?
Usually, yes. Most foreigners never need one. If your visa is valid, your passport is the one your visa is in and nothing on your record is unresolved, MHA's published regulations say you do not need departure clearance from your registration office and can depart straight through the immigration check post; if you are registered and leaving for good, you surrender your registration certificate to the registration office or to the immigration officer when you exit. Pakistani citizens are the exception to that rule. An Exit Permit is needed when your stay has become irregular: an overstay, an expired visa, a lost or stolen passport replaced by a new one, a baby born in India, or a case the FRRO has flagged.
Will an overstay affect my future visas for India?
It can, and no honest adviser will promise otherwise. An overstay, and how it was resolved, stays on your immigration history, and future visa and entry decisions are made by the Indian authorities at the time you apply. Under the Immigration and Foreigners Act, 2025, remaining in India beyond your visa's validity can carry imprisonment of up to three years, a fine of up to ₹3,00,000, or both, although those are ceilings for prosecution rather than routine outcomes. What helps is a record that shows you came forward, dealt with the assessment and left on a valid Exit Permit, rather than being identified at the airport. When you apply again, answer every question about your history truthfully.
