If you married an Indian citizen while you were in India on a visa, you may not have to leave to stay on as a spouse. MHA's visa guidelines provide that when a foreign national on an e-Visa, Visa on Arrival, Tourist, Business, Employment, Student or Research Visa marries an Indian national, a Person of Indian Origin or an OCI cardholder during the validity of that visa, the FRRO may convert it to an Entry (X-2) visa, the category for foreign spouses and children of Indian citizens, PIOs and OCI cardholders. Timing decides most cases: the marriage has to fall within your visa's validity, and the application should go in well before that visa runs out. The guidelines also let FRROs regularise, case by case, the stay of foreigners who entered on a Tourist Visa and have stayed on for years because of marriage to an Indian national. An X-2 visa does not permit employment, and you will need to meet any FRRO registration requirement on it. For many couples, OCI is the longer-term destination once the marriage qualifies. Do I have to leave India to get an X visa after marrying an Indian citizen?

Not if you married while your visa was still valid. Can e-Visa and Visa on Arrival holders convert to an X-2 visa?

They are named in the rule. MHA's guidelines list the e-Visa and the Visa on Arrival alongside Tourist, Business, Employment, Student and Research Visas as visas the FRRO may convert to Entry (X-2) when the holder marries an Indian national, a Person of Indian Origin or an OCI cardholder during the visa's validity. That matters because e-Visas and Visas on Arrival are otherwise non-extendable and, apart from specific cases like this one, non-convertible. Their short validity also makes timing tight, so register the marriage and apply as early as you can. Confirm the current position with your FRRO, since the guidelines predate the Immigration and Foreigners Act, 2025.

What if we married after my visa had already expired?

Then the standard route does not fit, because it depends on the marriage taking place during your visa's validity, and your situation starts with an overstay that has to be dealt with. MHA's guidelines do give FRROs a separate, discretionary power to regularise, case by case, the stay of foreigners who entered on a Tourist Visa and have stayed in India for many years because of marriage to an Indian national, and to convert their visas to Entry (X-2). That power is not a right, and it does not make an overstay disappear. Take advice before approaching the FRRO, have your marriage registration and history documented, and expect the overstay to be part of how the case is considered.

Can I work in India on an X-2 visa?

No. The conversion application includes an undertaking from you that you will not take up employment or do business in India, and the Entry visa is not a work visa. If you want to work, you need an Employment Visa in your own right, which normally means a fresh application sponsored by an employer. MHA's rules contain one narrow in-country exception: a Bangladeshi national on an X-2 visa, married to an Indian national but not entitled to OCI, can have that visa converted to an Employment Visa by the Ministry of Home Affairs, subject to a minimum salary of ₹9.10 lakh a year. For most spouses, OCI, once the marriage qualifies, is the route that changes what you can do.

How long is an X-2 visa valid, and can it be extended?

MHA's rules allow an X-2 visa to be granted for up to five years at a time, with multiple entry. Once five years have passed from the date the visa was issued, a further extension is referred by the FRRO to the Ministry of Home Affairs for clearance, and the Ministry grants an extension of one year. Subsequent extensions of up to another five years at a time can then be granted by the FRRO, with the same procedure repeated if further extension is needed. The validity granted on a conversion is decided in your case, so check the dates on the visa you receive rather than assuming the maximum.

What happens to an X-2 visa if my spouse dies or we divorce?

MHA's rules set this out. If your Indian spouse dies and you have a child together and have not remarried, the FRRO may extend your stay on the X-2 visa, subject to the usual checks. If you are widowed without children, the X-2 visa is cancelled and you are granted exit. After a divorce, if a court has given you custody of your child and you have not remarried, an extension may likewise be allowed; without a child, the visa is cancelled and exit is granted. If you remarry another foreign national, no extension is allowed. If you remarry an Indian national, the existing X-2 is cancelled and you are advised to return on a new X-2 visa.

When can a foreign spouse apply for OCI instead?

A foreign spouse of an Indian citizen or of an OCI cardholder can generally apply for OCI once the marriage has been registered and has lasted for at least two continuous years before the application. Until then, the Entry (X-2) visa is the bridge that lets you live in India with your spouse. Applying for OCI too early is a common mistake that costs time, so check the dates against your marriage registration first.
