Can a foreign company have foreign national directors in India?
Yes. Foreign companies operating through Indian subsidiaries can appoint foreign nationals as directors. Such directors typically need appropriate visas (Business or Employment Visa depending on their role and whether they draw a salary from the Indian entity) and must comply with Indian company law requirements.
Does a foreign company need to register in India to hire employees there?
Yes. If a foreign company wishes to employ people in India (including foreign nationals), it generally needs to establish a legally recognized entity in India, such as a subsidiary or branch office. We advise on the most appropriate structure for your business.
How many foreign nationals can work for an Indian company?
There is no fixed statutory limit on the number of foreign nationals who can work for an Indian company, but each must individually qualify for and hold a valid Employment Visa. The Indian company must also have the financial capacity to justify the employment.
