Can you change your visa category without leaving India?

Only in specific cases. MHA's rules treat Tourist, e-Visa, Visa on Arrival, Business and Employment Visas as non-convertible except where a defined route exists, and wanting to stay longer or to start working is not one of them. The clearest route is marriage: if you marry an Indian national, a Person of Indian Origin or an OCI cardholder while your visa is valid, the FRRO can convert it to an Entry (X-2) visa. The guidelines quoted here date from 2018, before the Immigration and Foreigners Act, 2025 took effect, so confirm the current position with your FRRO.

India's rules treat most visas as non-convertible: MHA's guidance says Tourist, e-Visa, Visa on Arrival, Business and Employment Visas cannot be converted to another category except in specific cases. Conversion still appears as a service on the e-FRRO portal, which is why people reasonably expect it to be routine, but the specific cases are narrow and defined. The clearest is marriage to an Indian national, a Person of Indian Origin or an OCI cardholder during your visa's validity, which the FRRO can convert to an Entry (X-2) visa. Others cover Persons of Indian Origin, unexpected illness, and a few employment situations that need the Ministry of Home Affairs' approval, and requests outside the FRRO's delegated powers are referred to the Ministry. Wanting to stay longer, or to start working on a tourist or business visa, is not a conversion route: the answer there is a fresh application from abroad. Common Questions About Visa Conversion

Can I convert my tourist visa to an X visa after marrying an Indian citizen?

Yes, if the marriage took place while your visa was still valid. MHA's visa guidelines allow the FRRO to convert an e-Visa, Visa on Arrival, Tourist, Business, Employment, Student or Research Visa to an Entry (X-2) visa when the holder marries an Indian national, a Person of Indian Origin or an OCI cardholder during that visa's validity. You apply through e-FRRO, and the FRRO decides, so the conversion is permitted rather than automatic. MHA's supporting-documents list for this conversion asks for a marriage certificate issued by a Registrar of Marriages or an Indian Mission abroad, a copy of your Indian spouse's passport, and an undertaking that you will not take up employment or do business in India. Apply well before your current visa runs out, and confirm the current position with your FRRO, because the guidelines date from 2018.

Can I convert a tourist or business visa to an employment visa in India?

Not as a conversion. Tourist and Business Visas are non-convertible other than in the specific cases MHA's guidelines set out, and taking up a job is not one of them. The Bureau of Immigration's guidance is that foreigners who want to work in India should arrive on a valid Employment Visa, and that visa has its own conditions, including a gross salary above ₹16.25 lakh a year other than in exempted sectors. A job offer received while you are in India does not create a route to convert. The practical path is a fresh Employment Visa application sponsored by the employer, generally made from your home country, without starting work until that visa is in place.

Can I change employer on an Employment Visa without leaving India?

Generally no. MHA's rules say no change of employer is permitted while an Employment Visa is current, with one defined exception: a move between a registered holding company, its joint ventures or consortiums and their subsidiaries, or between those subsidiaries, at a senior or managerial level or in a skilled role such as a technical expert, and even then only with the Ministry of Home Affairs' prior permission. Outside that exception, the route is to leave India and apply for a fresh Employment Visa sponsored by the new employer. Tell the FRRO if your employment ends, and do not start with a new employer before the right visa is in place.

What if I fall ill in India on a tourist visa?

The rules provide for this, usually without a conversion. Under MHA's guidelines, a Tourist, Business, Employment, Student or Research Visa holder with a minor condition that needs no hospital stay or prolonged treatment can simply be treated. For a sudden illness that needs continuous treatment for less than 180 days, or within the stay your visa allows, you apply to the FRRO for a Medical Permit, supported by a certificate from a government or recognised hospital, and your visa is not converted. Conversion to a Medical Visa is needed only if treatment will run beyond 180 days or your visa's permitted stay. If treatment was the reason for the trip, though, the Medical Visa was the category to travel on.

Can a dependant on an X visa study or work in India?

Study and work are treated differently. MHA's supporting-documents list includes converting a dependant's Entry visa to a Student Visa, or a Research Visa, through the FRRO, so a dependant who enrols on a course has a defined route. Work is narrower. The spouse of an intra-company transferee holding an E-3X visa can move to an Employment Visa inside India, meeting all its conditions, with the Ministry of Home Affairs' prior approval. A Bangladeshi national on an X-2 visa, married to an Indian national but not eligible for OCI, can be converted to an Employment Visa by the Ministry, with a minimum salary of ₹9.10 lakh a year. Anyone else needs their own Employment Visa before starting work.

What happens if my visa expires while a conversion is pending?

Do not assume a pending application protects your stay. Apply well before your visa runs out, keep the e-FRRO acknowledgment, and answer any query the FRRO raises the same day. If the expiry date is approaching with no decision, contact your jurisdictional FRRO at once rather than waiting. The marriage route in particular depends on the marriage taking place while your visa is valid, and once a visa lapses the conversation becomes about an overstay, which carries its own consequences under the Immigration and Foreigners Act, 2025 and is handled far less sympathetically than a timely application.
