Stay or leave? When your Indian visa situation gets tight, everything depends on choosing the right instrument — a visa extension to remain, or an Exit Permit to depart lawfully. Here's how to decide.

Two Instruments, Opposite Goals

When a stay in India runs long, people often confuse two very different tools:

  • A visa extension lets you lawfully remain in India — applied for before your permitted stay ends, while your original purpose continues.
  • An Exit Permit lets you lawfully leave India — required when your visa is no longer valid, you have overstayed, or your departure needs clearance (for example after a lost passport).

One keeps you in; the other gets you out cleanly. Choosing wrongly wastes precious days — and days matter enormously here.

Why Timing Decides Everything

The boundary between the two instruments is your permitted-stay end date — usually the duration-of-stay, not the visa's outer validity:

  • Before that date, the extension door is open (for eligible categories), and leaving is simple.
  • After it, the extension door largely closes and the Exit Permit becomes the way out — typically with your status regularised first, which can involve penalties under the FRRO's official schedule; serious cases are governed by the Immigration and Foreigners Act, 2025.

This is why "I'll sort it out next week" is the most expensive sentence in Indian immigration.

Can You Apply for Both?

Not really — they answer opposite questions. What does happen in practice: someone applies to extend, is refused, and must pivot to departure. If that's you, move quickly: while your stay is still valid, an ordinary departure needs no permit; once it lapses, you're into overstay territory and Exit Permit procedure.

Common Scenarios

The employee whose contract ended

Employment finished, visa tied to the employer — an extension no longer fits. Depart within your permitted stay, or seek advice immediately if it has lapsed.

The patient whose treatment continues

Medical visas are generally extendable with a hospital certificate — extension, not exit, is the answer while treatment genuinely continues.

The traveller who simply lost track

Tourist stays are generally not extendable. If the date has passed, the Exit Permit route through the e-FRRO portal is the lawful way home.

Frequently Asked Questions

If my extension is pending and my stay expires, am I overstaying?

A pending application filed in time is generally taken into account — one more reason to file early and keep the acknowledgment. Filing after the lapse does not cure an overstay.

Do I need an Exit Permit if my visa is still valid?

Generally no — with a valid visa and stay, and no compliance issues, you simply depart. Exit Permits are for cases where normal departure isn't possible.

How fast can an Exit Permit be issued?
